By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Definitions

  • Account: your user account used to access the Service.

  • Challenge / Arena: a time-bound or ongoing skill-based competition on the Service with published rules and entry requirements.

  • Entry / Attempt / Play: a participation instance in a challenge as recorded by the Service.

  • Tickets: digital access units used to enter certain challenges and to unlock certain participation features.

3. Eligibility, Age, and Jurisdiction

  • You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is higher) and legally capable of entering into these Terms.

  • You are responsible for ensuring that access to and use of the Service, including participation in challenges and receipt of prizes, is lawful in your location.

  • The Service may be unavailable, restricted, or modified in certain jurisdictions. Participation may be void where prohibited.

  • We may require verification of age, identity, eligibility, or residency (including documentary evidence) in order to allow participation, prevent fraud, comply with law, or fulfill prizes.

4. Nature of the Service (Skill-Based Competition)

  • Turbo Trophy offers skill-based challenges. Outcomes depend primarily on player performance under published rules (e.g., time, precision, strategy) and validation procedures.

  • Tickets are not a bank deposit, stored value account, or financial instrument. Tickets may not be redeemed for cash except where required by mandatory law.

  • No guarantee is made that any user will win a prize. Prizes are awarded only in accordance with the applicable challenge rules and verification requirements.

5. Account Registration, Security, and User Responsibilities

  • You must provide accurate, current, and complete information and keep it updated as necessary.

  • You are responsible for maintaining the confidentiality of login credentials and for all activity under your account.

  • You may not share accounts, sell accounts, or use another person’s account.

  • You must promptly notify us of any suspected unauthorized access, security incident, or compromise (contact: info@turbotrophy.com).

6. Tickets, Entries, and Challenge Rules

  • Ticket pricing, entry cost, participation limits (e.g., cooldowns, max attempts), and other conditions are displayed in the Service.

  • When you enter a challenge, the displayed ticket cost is consumed and recorded.

  • Challenges may impose limits including (without limitation) max total entries, max entries per user, max attempts per user, cooldowns, start/end times, eligibility restrictions, or password protection.

  • Applicable documents governing participation include:

  • these Terms;

  • the Challenge & Contest Rules;

  • the Fairness Policy; and

  • the Prize Fulfillment Rules.

7. Purchases, Payments, Taxes, and Price Presentation

  • Purchases may include tickets or subscriptions/memberships where offered.

  • Payments are processed by third-party payment processors (e.g., Stripe). Turbo Trophy does not store full payment card numbers (PAN) or CVV on its systems.

  • Prices, currency, and any applicable taxes/fees are displayed prior to checkout. You authorize the charged amount by confirming checkout.

  • If your payment method fails, is reversed, or is charged back, we may suspend access, reverse granted tickets where permitted, investigate for fraud, and withhold or revoke prizes to the extent allowed by law.

8. Memberships / Subscriptions (If Offered)

  • Where a membership/subscription is offered, the terms presented at checkout apply, including price, billing interval, renewal, and cancellation options.

  • We may provide membership benefits such as boosts, perks, or support prioritization. Benefits may be modified for operational, security, or legal reasons with notice where appropriate.

9. Prize Determination, Verification, and Fulfillment

  • Winners are determined according to published challenge rules and ranking logic after validation and finalization.

  • We may require identity and eligibility verification prior to prize fulfillment. Failure to complete verification within the stated timeframe may result in forfeiture where permitted by law.

  • Prize delivery timelines, shipping logistics, customs duties, and tax responsibilities are described in the Prize Fulfillment Rules and challenge-specific disclosures.

  • We may substitute prizes of equal or greater value if necessary due to availability, supplier issues, safety, or legal/compliance reasons.

10. Fair Play, Integrity, and Prohibited Conduct

You must not, and you must not attempt to:
  • cheat, exploit, reverse engineer gameplay logic for unfair advantage, or manipulate scoring or validation;

  • use bots, macros, automation, or scripted inputs that provide an unfair advantage (unless expressly permitted for accessibility and approved in writing);

  • modify clients, tamper with network traffic, bypass limits, or interfere with security mechanisms;

  • collude, engage in match-fixing, or use multi-accounting to gain an advantage;

  • abuse refunds/chargebacks, submit fraudulent claims, or attempt to obtain prizes by deception;

  • harass, threaten, defame, or submit unlawful content; or

  • violate any applicable law, regulation, or third-party right.
We may apply integrity measures including telemetry analysis, rate limiting, score invalidation, manual review, disqualification, suspension, termination, and prize revocation/withholding to the extent permitted by law.

11. Content, License, and Intellectual Property

  • The Service, including its software, design, text, graphics, brand elements, and documentation, is owned by Turbo Trophy and/or its licensors and is protected by intellectual property laws.
  • You retain ownership of your Content, subject to any third-party rights. You grant Turbo Trophy a worldwide, non-exclusive, royalty-free license to host, use, reproduce, display, and distribute your Content as necessary to operate, secure, and improve the Service (including displaying usernames/avatars on leaderboards).
  • You represent and warrant that you have the rights necessary to provide your Content and that it does not violate law or third-party rights.

12. Service Availability, Changes, and Beta Features

14. Disclaimers

  • The Service is provided “as is” and “as available”.

  • To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including fitness for a particular purpose and non-infringement.

  • Turbo Trophy does not guarantee that challenges, prizes, or features will always be available or that participation will result in any prize.

15. Limitation of Liability

To the maximum extent permitted by law:
  • Turbo Trophy is not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill.

  • Turbo Trophy’s aggregate liability arising out of or relating to the Service is limited to the greater of: (a) 100 (in local currency) or (b) amounts paid by you to Turbo Trophy in the 6 months preceding the event giving rise to the claim.

This limitation does not apply where liability cannot be excluded or limited under mandatory law (including, where applicable, liability for intent, gross negligence, or mandatory consumer rights).

16. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Turbo Trophy from claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising out of your breach of these Terms, misuse of the Service, violation of law, or infringement of third-party rights.
